The terms and conditions set out herein ("Terms") constitute an agreement between NextG Derma, a company incorporated under the laws of India ("we", "NextG Derma", "us", or "our"), which manages and operates an online marketplace at www.nextgderma.com
(collectively referred to as the "Platform") and any natural or legal person who accesses and/or uses the Platform ("you" or "your") or uses any current or future service or functionality available on the Platform ("Service(s)"), as updated from time to time.

The Platform is designed to provide users with access to skincare and personal care products. We grant you a limited, non-exclusive, revocable license to access and use our Platform for personal, non-commercial purposes. You agree not to modify, reverse engineer, decompile, or attempt to extract the source code of our Platform. Any use of automated systems or software to extract data from the Platform for commercial purposes ('scraping') is strictly prohibited.
Account Registration and Management
To access certain features of our Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to suspend or terminate accounts that contain false or misleading information.

When using our Platform, you agree to conduct yourself in a respectful and lawful manner. You shall not engage in any activity that interferes with or disrupts the Platform or its servers. You are responsible for obtaining and maintaining any equipment or ancillary services needed to connect to or access our Platform, including but not limited to internet connection, mobile devices, or computers.

While we strive to provide accurate product descriptions, images, pricing, and availability information, we do not warrant that product descriptions or other content on the Platform is accurate, complete, reliable, current, or error-free. The availability of products is subject to change without prior notice. We reserve the right to discontinue any product at any time. Ordering Process

We reserve the right to verify payment information and to decline or cancel orders in cases of suspected fraud, unauthorized or illegal transactions.
Shipping and Delivery
We partner with reliable courier services to deliver products to your specified address. Delivery timeframes provided are estimates only and may vary based on location, availability, and other factors beyond our control. Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier. We are not liable for any delays, loss, or damage occurring during transit. Additional charges may apply for express delivery or remote locations.
Returns and Refunds
Our return policy is designed to ensure customer satisfaction while maintaining product quality. Products may be returned within 7 days of delivery if they remain unused, in original packaging, with all tags attached. Certain items including personal care products that have been opened or used cannot be returned due to hygiene concerns. Before initiating a return, please contact our customer service team with your order details and reason for return.
The return process requires proper documentation, including original purchase invoice and unused condition of the product. Upon receiving the returned item, our quality assurance team will inspect the product to ensure it meets return criteria. Approved returns will be processed for refund within 5-7 business days to the original payment method. Shipping charges for returns are generally borne by the customer unless the return is due to our error or product defect.
Intellectual Property Rights
All content present on the Platform, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, trademarks, service marks, trade names, and product packaging, is the exclusive property of NextG Derma or its content suppliers and is protected by Indian and international copyright and intellectual property laws.
You acknowledge that the Platform contains proprietary content, information, and material protected by intellectual property and other laws. You agree not to use such proprietary content, information, or materials other than as expressly permitted for personal, non-commercial purposes. No part of the Platform may be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose without our express written consent.
Privacy and Data Protection

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. You agree to indemnify, defend, and hold harmless NextG Derma, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account by you or any other person accessing the Platform using your account.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat. You agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such claims.
Force Majeure
NextG Derma shall not be liable for any delay or failure to perform its obligations under these Terms arising from circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemic, epidemic, civil unrest, natural disasters, government actions, strikes, lockdowns, system failures, or internet disruptions.
Account Termination
We reserve the right to terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including but not limited to breach of Terms. Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform and contact us for account deletion.
Product Authenticity and Quality Assurance
We are committed to providing genuine, high-quality products. All products sold through our Platform are sourced directly from authorized manufacturers or their designated distributors. We maintain strict quality control measures and proper storage conditions to ensure product integrity. However, we recommend that users review product ingredients carefully to avoid any allergic reactions.

We reserve the right to modify or withdraw promotional offers at any time. Promotional codes cannot be combined unless explicitly stated.
Severability Clause
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.
Technical Requirements and Platform Compatibility
To access and use our Platform optimally, you must ensure your device meets certain technical requirements. This includes but is not limited to:

Order Tracking and Updates
Once an order is placed, you will receive confirmation via email and SMS. You can track your order status through your account dashboard or using the tracking number provided. While we strive to maintain accurate delivery estimates, actual delivery times may vary based on external factors beyond our control.
